Applying for Reinstatement/Readmission to The Florida Bar
Attorneys who have been suspended from the Florida Bar or who have been officially designated as “inactive” for reasons not related to misconduct have a right to apply for reinstatement or readmission. In Florida, these matters are handled pursuant to the Section 3.7.10 of the Rules Regulating The Florida Bar. This rule establishes the criteria that must be met by attorneys who are seeking reinstatement or readmission to the Florida Bar. Notably, under the state’s professional rules, attorneys seeking reinstatement or readmissions are typically required to go through the complete screening process, including:
- A comprehensive background investigation; and
- Clearance of character and fitness requirements.
As a general rule, the reinstatement or readmission process will take several months. Though, the amount of time it can take will vary based on a number of different factors. When seeking readmission, attorneys must put together a well-prepared Petition for Reinstatement. If the petition is deemed to be incomplete or inaccurate, reinstatement is likely to be delayed or even denied outright.
