Two Golf Cart Occupants Injured in a Distracted Driving Crash

GolfCart2

According to a report from WBBH-TV Fort Myers, two people were rushed to an area hospital after a golf cart accident on Bayshore Road and Indian Creek Drive. The injured victims—a 73-year-old man and a 74-year-old woman—were reportedly ejected from their golf cart when it was struck by an oncoming vehicle. While the injuries were both reported to be serious, they are not believed to be life-threatening.

A representative from the Florida Highway Patrol (FHP) told reporters that the at-fault driver was reaching for his cell phone when the collision occurred. The phone apparently fell beneath the passenger seat. When he reached for it, his vehicle veered directly into the next lane, where the golf cart was coming in the opposite direction. The crash is still under a more comprehensive investigation.

A Golf Cart is Not a Motor Vehicle Under Florida’s No-Fault Car Accident Law

In Florida, motorists are required to purchase no-fault Personal Injury Protection (PIP) coverage. After a minor or modest collision, your own no-fault insurance policy should cover your initial medical bills and lost wages. However, golf carts are not covered by Florida’s no-fault auto accident laws. This is true even when you operate your golf cart on public roads.

Golf cart operators are not required to carry no-fault PIP coverage in Florida. If you are injured in a crash caused by another driver’s negligence, you have the right to file a personal injury lawsuit against the responsible party. You are not restricted by Florida’s no-fault auto accident regulations. Of course, you are also not likely protected by your PIP policy.

You Deserve Full Financial Compensation for Golf Cart Accident Injuries

Through a personal injury claim, Florida allows golf cart accident victims to seek financial compensation for both economic and non-economic damages. Put another way, you are entitled to seek money for the complete value of your damages. Unfortunately, the insurance providers that defend most motor vehicle accident claims are highly aggressive. They fight to limit settlement offers. At Pike & Lustig, LLP, our Florida golf cart accident lawyers are adept in helping people maximize their monetary recovery. Depending on the severity of your golf cart accident injuries, you may be entitled to compensation for:

  • Golf cart repairs or golf cart replacement;
  • Emergency room treatment;
  • Other medical costs;
  • Physical therapy;
  • Lost wages;
  • Loss of earning power;
  • Pain and suffering;
  • Permanent physical impairment; and
  • Wrongful death.

Although the majority of personal injury claims are settled outside of the courtroom, you should always be ready for litigation. If you were hurt in a golf cart collision, our law firm is ready to take action to get you the compensation you need.
