Trademark infringement occurs when a person or company without the consent of the owner of the mark uses a copy and imitation or reproduction of a mark to utilize on their own business and in commerce that reproduction or copy imitation. In turn, that results in a likelihood of confusion or in a likelihood that consumers will be deceived or will cause a mistake as to the association or affiliation of the company with the owner of the mark.
